Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("AUP") sets out the rules governing your use of MerchantMind ("the Service"). By using the Service, you agree to comply with this policy. This AUP should be read together with our Terms of Service and Privacy Policy.

2. Permitted Use

You may use MerchantMind solely for its intended purpose — automating price management for your own legitimate Takealot seller account(s). Specifically, you may:

  • Connect your Takealot seller account(s) using your own valid API key
  • Configure repricing rules and price floors/ceilings for your products
  • Monitor competitor pricing data for products you sell on Takealot
  • Allow the Service to submit price updates to Takealot on your behalf

3. Prohibited Use

You must not use MerchantMind to:

3.1 Unlawful Activity

  • Violate any applicable South African or international law or regulation
  • Engage in price-fixing, collusion, or any anti-competitive conduct prohibited under the Competition Act
  • Commit fraud or engage in deceptive trading practices

3.2 Platform Abuse

  • Violate Takealot's seller terms of service, policies, or guidelines
  • Submit false, misleading, or manipulated pricing data to Takealot
  • Use the Service to manage seller accounts that you do not own or are not authorised to operate
  • Scrape, harvest, or extract data from Takealot beyond what the Service provides

3.3 Service Misuse

  • Attempt to reverse-engineer, decompile, or extract the source code of MerchantMind
  • Probe, scan, or test the vulnerability of the Service or its infrastructure
  • Introduce malware, viruses, or malicious code into the Service
  • Use automated means (bots, scripts) to access the Service in ways that exceed normal usage
  • Share account credentials or allow unauthorised third parties to access your account
  • Resell, sublicense, or commercially redistribute access to the Service without written consent

3.4 Harmful Conduct

  • Use the Service in a way that damages, disrupts, or places unreasonable load on our infrastructure
  • Interfere with other users' access to or enjoyment of the Service
  • Attempt to gain unauthorised access to any other user's account or data

4. Your Responsibility for Pricing Decisions

MerchantMind automates price changes based on rules you configure. You remain solely responsible for:

  • Setting appropriate minimum and maximum prices that protect your margins
  • Ensuring your pricing complies with Takealot's pricing policies
  • Any consequences arising from prices submitted to Takealot by the Service on your behalf
  • Ensuring your use of automated repricing does not violate any competition or consumer protection laws

MerchantMind is a tool — pricing decisions and their consequences remain your responsibility.

5. API Key Security

Your Takealot API key grants access to your seller account. You must keep it confidential and must not share it with unauthorised parties. If you believe your API key has been compromised, revoke it from Takealot immediately and update it in MerchantMind. MerchantMind is not liable for any damage caused by unauthorised use of your API key.

On our side, your API key is stored in an access-controlled production database, used solely to act on your own Takealot store, and is never shared, sold, or exposed to other customers. See our Privacy Policy for full detail on how we protect your data.

6. Enforcement

We reserve the right to investigate suspected violations of this AUP. If we determine that a violation has occurred, we may:

  • Issue a warning
  • Suspend or terminate your account without refund
  • Report the conduct to relevant authorities
  • Pursue legal remedies where appropriate

7. Reporting Violations

If you become aware of any violation of this AUP, please report it to us at info@merchantmind.co.za.

8. Changes to This Policy

We may update this AUP from time to time. Continued use of the Service after changes take effect constitutes your acceptance of the updated policy.
